Rent Reporting and Rewards Terms
Effective date: October 19, 2026
THESE CREDIT BUILDER SUPPLEMENTAL TERMS ARE A LEGAL AGREEMENT BETWEEN YOU AND RENTSPREE AND GOVERN YOUR USE OF THE CREDIT BUILDER SERVICE (THE “SERVICE”) PROVIDED THROUGH THE PLATFORM BY RENTSPREE, INC. (“RENTSPREE”, “US”, “OUR” OR “WE”) IN COOPERATION WITH PIÑATA (DEFINED BELOW).
BY USING THE SERVICE YOU AGREE TO BE BOUND BY BOTH THESE SUPPLEMENTAL TERMS (“CREDIT BUILDER TERMS”) AND RENTSPREE’S TERMS OF SERVICE INCLUDING THE PROVISIONS RELATED TO MANDATORY ARBITRATION (WHICH MEANS THAT YOU AGREE TO SUBMIT ANY DISPUTE RELATED TO YOUR USE OF THE SERVICE TO BINDING ARBITRATION RATHER THAN PROCEED IN COURT, UNLESS YOU OPT OUT AS DESCRIBED IN THE TERMS OF SERVICE), JURY WAIVER, PROHIBITION OF CLASS ACTIONS AND DISPUTE RESOLUTION.
BY CLICKING “I ACCEPT”, “SUBMIT” OR SIMILAR BUTTON INDICATING YOUR AGREEMENT, OR OTHERWISE USING THE SERVICE, YOU REPRESENT THAT YOU’VE READ, UNDERSTAND AND AGREE TO BE BOUND BY THESE CREDIT BUILDER TERMS AND THE TERMS OF SERVICE. IF YOU DON’T AGREE WITH THESE CREDIT BUILDER TERMS AND THE TERMS OF SERVICE, YOU MAY NOT USE THE SERVICE. IF THERE IS A CONFLICT BETWEEN THE TERMS OF SERVICE AND THESE CREDIT BUILDER TERMS, THESE CREDIT BUILDER TERMS WILL CONTROL.
RentSpree may update these Credit Builder Terms from time to time. When material changes are made, RentSpree will make reasonable efforts to provide notice to you, and any fee change will be made only as described in the “Fees” paragraph below. Except as provided there, your continued use of the Service after updated Credit Builder Terms are posted constitutes your acceptance of them. We encourage you to regularly check the Terms of Service and these Credit Builder Terms to view the most current terms. In addition, by using the Service you agree to be bound by RentSpree's Privacy Policy and the Third-Party Services Terms.
As part of the Service, you may elect to have your rent payment history (“Payment Information”) reported to one or more consumer reporting agencies, such as TransUnion, Equifax, and Experian (“CRAs”). The Service is currently provided by Piñata Rent, Inc. (“Piñata”), which operates the rent-reporting program and, directly or through a reporting partner it identifies to you, furnishes Payment Information to the CRAs. Your enrollment in the Service is also subject to Piñata’s terms of service and privacy policy, which you will be asked to accept when you enroll.
RentSpree is not a furnisher. RentSpree is not a “furnisher” of information to consumer reporting agencies under the Fair Credit Reporting Act (FCRA), and RentSpree does not report your Payment Information or any other information to any CRA. Piñata (or its reporting partner) decides what is reported and is responsible for the accuracy and integrity of the information it furnishes and for investigating disputes as the FCRA requires. RentSpree is not a consumer reporting agency for purposes of the Service.
By enrolling, you authorize and direct RentSpree to share your Payment Information (such as payment dates, amounts and status) along with your name, contact information and rental address with Piñata so that Piñata can operate the Service. Piñata will tell you what it reports before you enroll. Any additional information needed to match you to your credit file, such as a Social Security number or date of birth, is provided by you directly to Piñata; RentSpree does not receive, use or share your Social Security number. You can find the CRAs’ privacy policies at the following URLs:
Experian: https://www.experian.com/privacy/
Equifax: https://www.equifax.com/privacy/
TransUnion: https://www.transunion.com/privacy/transunion
Unenrolling and disputes. You may stop future reporting at any time by un-enrolling in your RentSpree account or under Piñata’s program terms; unenrolling does not remove information already reported, which remains subject to the CRAs’ policies and applicable law. If you believe reported information is inaccurate, you may dispute it directly with Piñata or with the CRA. You may also contact [email protected], and RentSpree will correct any inaccuracy in its own records and forward your concern to Piñata.
Fees. The Service is offered free of charge. If RentSpree or Piñata charges a fee for the Service, the amount will be clearly disclosed before you enroll, and any increase to a recurring fee will be made only after notice at least 7 and no more than 30 days before it takes effect, giving you the opportunity to unenroll before the new fee applies.
We are not responsible for the use by Piñata or the CRAs of your Payment Information, including your personal information, that is provided to them. You understand that the CRAs may use the Payment Information to determine your credit score and creditworthiness, and that reported late or missed payments may lower your credit score. We disclaim all warranties regarding the use of this service, including any warranty regarding the impact, if any, providing such Payment Information will have on your credit score.
You expressly release us and waive any claims against us and our agents, employees, representatives, officers, directors, shareholders, attorneys, accountants, insurers, receivers, advisors, consultants, partners, partnerships, parents, divisions, subsidiaries, affiliates, assigns, independent contractors, successors, heirs, predecessors in interest, joint ventures and commonly controlled corporations (collectively, the “Released Parties”) for any claims, damages, or liability arising from the sharing of Payment Information with Piñata or its reporting to the CRAs (“Released Claims”), to the fullest extent permitted by applicable law. Released Claims do not include claims arising from our own fraud, gross negligence or willful misconduct, any right you have under the FCRA that cannot be waived, or any other claim that cannot be released under applicable law.
You also expressly and knowingly waive and relinquish any and all rights that you have or might have relating to the Released Claims under California Civil Code §1542 (and under any and all other statutes or common law principles of similar effect) which reads as follows:
A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.
